TERMS & CONDITIONS

Scope of Work

All services, labor, materials, products, and installations provided by Fields Home Improvements shall be governed by the proposal, estimate, invoice, work order, and project documents approved by the Client. Any work requested outside the original scope shall require a written change order and may result in additional charges.

Pricing & Proposals

Proposal pricing is based upon the scope of work, materials, and market conditions at the time the proposal is issued. Fields Home Improvements will make every effort to honor quoted pricing; however, material costs, supplier pricing, and unforeseen conditions may impact project costs.

Any increase exceeding ten percent (10%) of the original proposal amount shall require written approval from the Client before additional purchases or work proceed.

Proposals remain valid for forty-eight (48) hours unless otherwise stated in writing.

Deposits & Scheduling

Payment of the required deposit secures the Client's project start date and reserves scheduling availability. Deposits are non-refundable except in the event the project is canceled by Fields Home Improvements.

Approved proposals and signed agreements may only be canceled with the written consent of Fields Home Improvements. If a cancellation is approved, the Client remains responsible for labor performed, materials purchased, administrative expenses, restocking fees, and any costs incurred before cancellation.

Custom materials, special-order items, and non-returnable products are not eligible for cancellation or refund.

Payment Terms

Projects under $5,000 require a fifty percent (50%) deposit with the remaining balance due upon completion.

Projects between $5,000 and $15,000 require a fifty percent (50%) deposit, a twenty-five percent (25%) progress payment, and the remaining balance due upon project completion.

Final payment for the contracted scope of work is due immediately upon completion of the project.

Any unpaid balance may be subject to interest charges as permitted by applicable law. Fields Home Improvements reserves the right to suspend work, withhold services, or pursue collection remedies for unpaid balances.

Change Orders

Any additions, modifications, or deviations from the original scope of work must be documented in writing and approved by both the Client and Contractor prior to the commencement of additional work.

Verbal agreements, text messages, and informal communications shall not constitute approved change orders.

Approved change orders may require additional deposits or progress payments and shall be billed according to the Contractor's current pricing structure.

Project Delays

Fields Home Improvements shall not be responsible for delays caused by weather conditions, supplier shortages, material availability, labor shortages, acts of God, governmental actions, or circumstances beyond the Contractor's reasonable control.

Project schedules may be adjusted accordingly.

Right to Suspend Work

Fields Home Improvements reserves the right to suspend work due to nonpayment, unsafe working conditions, denied site access, material delays, or violations of this Agreement until the issue has been resolved.

Dispute Resolution

The parties agree to make every reasonable effort to resolve disputes through direct communication and good-faith negotiations.

Any disputes, claims, or controversies arising out of or relating to this Agreement or the services performed shall first be submitted to mediation. If unresolved, the matter shall be resolved through binding arbitration where permitted by applicable law.

Liability

The Client is responsible for protecting personal property, valuables, and furnishings within the work area.

Fields Home Improvements shall not be liable for pre-existing conditions, concealed defects, damages resulting from third-party contractors, or conditions beyond the Contractor's reasonable control.

Third-Party Services

These terms apply to any third-party products, decorative installations, or related services coordinated through Fields Home Improvements, including but not limited to painting, trim installation, light fixture installation, television mounting, and other project-related services.

Fields Home Improvements does not guarantee that materials, products, or services represent the lowest available market price.

Indemnification

To the fullest extent permitted by law, the Client agrees to indemnify and hold harmless Fields Home Improvements from third-party claims, damages, losses, liabilities, costs, or expenses arising from the actions or omissions of contractors, suppliers, subcontractors, or other parties hired or retained by the Client.

Photography Consent

The Client grants Fields Home Improvements permission to photograph completed work for use in portfolios, websites, social media, and marketing materials. No personal identifying information or addresses shall be shared without the Client's consent.

Entire Agreement

This Agreement, together with any proposal, estimate, invoice, approved change order, or project document, constitutes the entire agreement between the Client and Fields Home Improvements.

I understand that payment of my deposit secures my project start date and reserves my place on the Contractor's schedule.

I understand that additional work requested outside the original scope of work may require a written change order and additional charges.

I agree that final payment is due upon completion of the contracted scope of work.

I understand that custom materials, special-order items, deposits, and completed work may be non-refundable as outlined in this Agreement.

I acknowledge that project timelines may be affected by material availability, weather conditions, supplier delays, or circumstances beyond the Contractor's control.

I authorize Fields Home Improvements to photograph and use images of the completed project for portfolio, website, and marketing purposes.

Client Acknowledgment • By signing below, the Client acknowledges that they have read, understood, and agreed to the terms and conditions contained within this Agreement.
